1st CASE UNDER MEDIATION
PARTIES:
- a President of a western pharmaceutical company in Poland
- a Management board member, managing one of the departments of the company
- employees of this department
AMOUNT IN DISPUTE:
Loss of part of the profit and the reputation of the company because of poor performance or delay in the performance of projects resulting from the sudden departure of one of the key employees, cost of finding and introducing a replacement, potential cost of further conflicts in the team including expansion to other departments

2nd CASE UNDER MEDIATION
PARTIES:
- a manager of a sales team
- an employee dismissed due to poor sales results
AMOUNT IN DISPUTE:
- 3 months remuneration for the employee i.e. over PLN 40 000, reputation of the company towards clients who were directly cooperating with the employee, reputation of the manager, possibly the amount of compensation claimed by the employee through a civil court proceeding against the manager

3rd CASE UNDER MEDIATION
THE PARTIES:
- an employer represented by a member of the management board
- an employee who was dismissed after maternity leave
AMOUNT IN DISPUTE:
The employee’s 3 months remuneration i.e. over PLN 50 000, as well as additional costs if lost in a long court proceeding – remuneration for the whole duration of dispute e.g. approx. a year i.e. PLN 170 000 plus costs of legal support.

- an employer, a young Polish subsidiary of a western developer in Poland represented by the President, who doesn’t speak Polish and doesn’t know Polish employment law
- an architect, who was dismissed
AMOUNT IN DISPUTE:
3 months remuneration of the employee i.e. over PLN 30 000, additional costs if lost in a long court proceeding – remuneration for the whole duration of the dispute e.g. approx. a year, costs of legal service, sworn translations etc.

Mediation Clause

We encourage the inclusion of mediation clause in agreements:
Any dispute which results from such an agreement or which are connected, can be settled amicably by the International Mediation Centre at the International Chambers of Commerce in Poland. If the parties cannot reach a settlement through a mediation proceeding within 60 days from the filing of the motion for mediation or other term agreed in written form by the parties, each party can file a case to the appropriate court.
